Legal Question in Wills and Trusts in Louisiana

My husband died this pass year. My stepchild is executor of his estate. I received all the paperwork and filed our taxes now they want the refund. What are my rites? No probate was done cause he separated everything before his death. Debt free!

If the income is community property, then the refund is community property. You get your half and the use of the other half. When talking about money, it can onoy be used by spending it.
