Legal Question in Wills and Trusts in Maine
joint tenants
My brother and I have inherited a property in equal measure. I want to have him buy me out or buy him out. He cannot afford to buy my share and refuses to sell me his. What does one do?

Re: joint tenants
Bring an action in partition to compel a sale.
Re: joint tenants
I note that Florida counsel has already suggested a Partition Action. I agree with that suggestion as the only meaningful step to take under Maine law. It may lead to a mediated solution but is the only avenue I have found to leverage that opportunity if the parties cannot agree on their own.
Re: joint tenants
I agree with the suggestions of the other attorneys. There needs to be a partition action if there is no agreement. Please give me a call to discuss this matter if you have time.
