Legal Question in Bankruptcy in Maryland
Prior Bankruptcy Filing
I am 25 years old and about 2 months ago I filed for bankruptcy. It cost approx. $850, which wasn't bad at the time, however, my son (who was 1 1/2 at the time) became extremely ill (later found to have sleep apnia & asthma). I was unable to make both of my court dates (the original and the extension that followed almost a week later). I told the secretary of the Attorney that I wouldn't be able to make it due to the sickness of my child.
I was unable to keep in contact because of the severity and demand of my son. I now attend class (=financial aid) during the day and work a graveyard shift and make $40k annually, however it is offset by my expenses. I know that the claim would've been granted had I been able to make it to the hearings. I can no longer afford the $850 discounted amount and now my old creditors are after me due to the dismissal and I'm afraid I will be imprisoned because I can't afford to pay them back. I don't know what to do and any information or direction would be greatly appreciated.

What a dilemma. You indicate that you had legal representation for your bankruptcy filing; should you have given notice of your inability to attend the 341 hearing to your counsel, counsel would have continued your appearance to a subsequent date.. ..the trustee usually allows for one 'non-attendance' w/o notice in KS. ..there must be some other reason for the dismissal. Your legal counsel is the only one who can answer your questions w/o more information. You are finding out that your creditors may now pursue payment of your obligations. . .contact your legal counsel.
