Legal Question in Civil Rights Law in Maryland

Freedom of Expression (Baseball Caps)

My question is re: freedom of expression. Within the last month, my fiancee has been asked to ''turn your hat around'' upon entering 2 different Maryland bar/restaurants (if he wants to be served). The hat in question is a Harley Davidson (HD) baseball cap - - no profanity, the HD logo reads the same on the front as the back. My question, isn't this a violation of his constitutional rights? How can anyone (person or business) instruct you on how to wear an article of clothing? I'm disturbed by this trend since its happened twice in the past month. What's next, denying service to patrons wearing Lee jeans, inside out teeshirts (well, you get the picture)? Any idea who I might contact to pursue further and/or find an answer to my question?

Re: Freedom of Expression (Baseball Caps)

Your fiancee asked you turn the hat around, did any employee in the restaurant ask you?

First, the First Amendment prohibits, among other things, the government from infringing on the freedom of speech. Private entities are not governed by the First Amendment.

I know of no law that prohibits a restaurant from establishing a dress code.

However, in seeking legal advice, as in medical advice, you should always seek several opinions.

This reply does not establish an attorney-client privilege. If further advice is needed, a full consultation with an attorney is recommended.
