I purchased a car in February and the 1st payment was due in march. I lost my job and was evicted from my home. I have been trying to get another job, but have been unsuccessful. I haven't made a payment on the car. My dad got a call from a private investigater saying that they were going to criminaly charge me with embezzelment and fraud. Can they do this. I will turn the car in, however I want to know can they lock me up when I turn in the car. My husband just got another job, and I am able to start making the payments. Could I file for bankruptcy?

There are many avenues you can try. To increase your negotiating power, you may want to try to obtain an attorney who specializes in consumer protection. Depending on the circumstances, the creditor MAY have violated certain consumer laws when he called your father. However, the consumer attorney could sit down with you to advise you of your rights and possibly direct you to a bankruptcy attorney.
