Legal Question in Credit and Debt Law in Maryland

My ex wife has a son from a previous relationship. Currently she is taking her son to the er using my social security number and health insurance. He is not on my insurance and the hospital is holding me responsible for the bills. The hospital said they can't do anything about it. Who should i contact to have this matter resolved.

First, contact your health insurance carrier to notify the carrier of the fraud. They should act immediately because its having a negative influcence on their bottom line.

Also, send a letter, certified mail/return receipt to your ex wife demanding she cease and desist this fraud. You can disclose you have already contacted your insurance carrier and intend to file criminal charges.

Check your credit report. If the charges show up dispute the debt. If it isn't resolved, you may be able to sue the hospital and the credit agency under the Fair Debt Collections Practices Act.

You may want to go the police (fraud unit) regarding her theft of medical services.

In addition, go the FTC's website to learn more about your wife's identity theft.
