What determines the penalty for being found guilty of 2nd degree assault. I understand the maximum penalties but what determines jail time or no jail time?

Jail time or no jail time in any criminal case is based on the seriousness of the assault, and the prior crimial record, if any, of the Defendant. That is why you should consult with a criminal lawyer, like myself.
