Legal Question in Criminal Law in Maryland

Can assault charges remain in juvenile court if the person has turned 18?

A person turned 18 in November but in December the person has an assault charge against him (but has been 18 less than thirty days). Can this charge be returned to juvenile court?

The person has a juvenile record but was charged as an adult in December. What are the options?

It may be possible to get the matter from a conviction. Depending on the charge(s) and prior convictions there is lattitude with sentencing guidelines. It all depends on the gravity of the charge(s) and the sufficiency of the State's evidence. Contact an attorney.

No, once a person has turned 18 any new charges are charged as an adult. This person should contact a criminal lawyer, like myself, immediately as their rights are different in adult court than they were in juvenile court.
