Legal Question in Criminal Law in Maryland
My boyfriend was allowing family members to stay in his home, and unbenounced to him, they were selling drugs. He was arrested in a raid on his home and has been passively waiting for this court case to come to a close for 4 years. The state of MD has seized his home and he has not had rights to his property, nor closure to this case for the entire 4 years. He has had 2 attorney's who have not been able to move this case to closure. Is there a statute of limitations for drug offenses? How long could this possiby go on? Is there even a legal basis for the state of MD to hold his house?
1 Answer from Attorneys
No, there is not a statute of limitations for this offense. However, there is a constitutional right to speedy trial. If there has not been a verdict in four years, then there may be a basis to argue for dismissal. There is no absolute time period to resolve the case. There is a legal basis to seize property alleged to have been involved in drug dealing.
