An appeal must be filed within 30 days of sentencing, but a petition for postconviction relief may be filed if a petitioner is still serving the sentence. Pursuing postconviction involves significant resources, because the petitioner has the burden of proof and must persuade the court why he did not take action while either the charge was pending trial or during appeal.
