Legal Question in Criminal Law in Maryland
My boyfriend is on probation right now for 2 years for theft $1000-10000 and tresspassing. Probation is supervised. He just got arrested and put in jail on bond for burglary 1st, 2nd and 3rd degree. theft less than $100 and malicious destruction of property under $500. He has been in jail now for 2 weeks. How much time can he get for these charges.

He may have to serve the remainder of his 2 year term for the probation violation. I'm unsure about the specific time he could serve on the 1st, 2nd, and 3rd degree burglary charges, although I'm sure that each carry jail time. The theft of less than $100 and destruction of property under $100 are misdemeanors and he will not face time for these.
I STRONGLY recommend that you hire a Maryland real estate attorney to advice you on your rights based on the specific facts of your case.

1st, 2nd and 3rd degree burglary carry 20y, 15y, and 10y, respectively. Theft under $100. carries 90d, and malicious destruction 3y. A guilty finding on the new charges can send him to jail for violating probation, even if no active incarceration is imposed for the new charges. I offer a free initial consultation.
