Legal Question in Criminal Law in Maryland

If someone is given a bracelet as a gift, and then the recepient finds out that the bracelet was stolen and then she gives the bracelet away to someone else, is the recepient of the stolen property guilty of theft or another crime? Once someone finds out they are in possession of stolen property is it their legal obligation to turn over to the authorities?

A person may be convicted of theft who possesses something that the person knows or should know is stolen. Giving it away may be found to be accessory after the fact or obstrution of justice. However, all of this may be difficult for the prosecution to prove.
