Legal Question in Criminal Law in Maryland

Someone was caught with 1 ecstacy pill. The officer said to go home, he did not issue any paperwork. The other person had weed and was a suspected dealer. He was taken in. Will paper work arrive by mail or did they not charge the first guy.

Unless the officer knows or learns the identity of the person whom he sent home, then the officer would have no way to charge the person. Assuming that the officer knows or learns, then the person may be charged by arrest warrant or by summons.

While information about pending cases is available online at Maryland CaseSearch, arrest warrants are not available. The only way to find out whether you have an arrest warrant is to contact law enforcement. Typically, they advise you to come in to the precinct, but if you have a warrant, that may cause you to be arrested immediately. It would be like turning yourself in, and before you did so, you would want to have made arrangements for bail or arrangements for your personal affairs in case you are not released. If the officer has decided not to charge, I suggest not doing or saying anything, such as contacting law enforcement that might cause the officer to reconsider.

If you have additional concerns, or if you are charged, I offer a free initial consultation.
