Legal Question in Criminal Law in Maryland
I have been charged with a crime and I am awaiting my court date.the states attorney already has my record.My question is if I send my paperwork in to have my record expunged before the court date can they still use it aganist me when I go to court.

Yes. The expungement petition will be denied if you are now a defendant in a criminal action that carries a possible jail sentence.

The rules prohibit an expungement, while you have a pending charge.
