Legal Question in Criminal Law in Maryland
I was charged with theft of $1,000 to $10,000 in Maryland. After 3 years of probation, my case was expunged. Since my criminal record has been expunged, can the FBI /NCIC still access the record? and if I apply for a federal job that requires a security clearance, do I still have to disclose the record even though it has been expunged? Also is probation before judgment considered a conviction under federal law?

As I understand it, the finding, but not the details remain available for national security and public safety purposes, such as a security clearance. You probably will be asked, and if you do not disclose, you would probably get in trouble for dishonesty. At the very least you probably would not get the job. Pbj is and is not a conviction under federal law, depending on the law.
