Legal Question in Criminal Law in Maryland
Is this child pornography? My ex-girlfriend who was 17 at the time sent a mirror picture in a thong facing away and let me take a picture laying down on her stomach in underwear. Nothing sexual is going on in either one. And also would just standing straight and naked be illegal. Thank you.

Federal law defines child pornography so broadly that possession of nude pictures of anyone under the age of 18 is considered to be possession of child pornography, even if nothing explicitly sexual is depicted. Parents have been charged, because of traditional baby pictures. The risk is that someone finds out and decides to alert law enforcement, a prosecutor decides to charge, and a jury decides to convict.
Although consultation with an attorney is confidential, message boards like this are not. Be careful what you post. If you have been charged, or if you believe that you may be charged, I offer a free initial consultation.
