Generally children under 18 are treated as juveniles. However, by statute the criminal court has original jurisdiction over certain offenses when committed by a person who is 16 or 17. Generally these offenses are the most serious violent ones, such as murder and rape. In these cases the 16 or 17 year old may be able to petition for transfer to juvenile court.
