Hello my name is David over the weekend my wife and got into a argument police were call to settle me down she told the officer I didn't hit her and she did want to give a statement but they locked me up and changed me with second degree assault if she don't go to court will the judge throw the case out

It depends on many factors. Starting with whether the State is concerned about the case, which could be because of your prior record, or how serious the assault is alleged to be. Also, it depends on the judge (for instance, Judge Johnson in Anne Arundel will issue an immediate body attachment for her (i.e. arrest her and bring her to court). Furthermore, it may be a better idea for her to come to court and tell the true story, depending on many factors involved in that decision as well.
