Legal Question in Criminal Law in Maryland

Help

Help is definitly what I need my husband violated his probation and was sentence to 18 months and I also found out that he has two charges pending using a different name. I attempted to get detailed information about the charges and because I didn't know his fake names I could not get the information. My questions are simple and probably will help many family members. My husband is a herion addict and not a bad criminal we all know he has to pay for his actions but I did not hire a attorney he had a public defender. Can I hire a attorney to secure to the amount of time he will recieve for the next two cases and properly explain his case to a judge. I am not rich so if you think I should leave well enough alone or is it worth hiring someone. The legal system is confusing to me. I don't want to leave him out to drown.

Your husband's case is, without question, complicated. His providing of false identity may likely prejudice him with his upcoming trials if he is to undergo a judge, rather than jury, trial even though a judge is to be impartial to this matter. Jury trials are MUCH more expensive. Your inability to obtain information can only be overcome by communication with your husband and he should give you this information for his own best interest. What he may fear is that you will divorce him and use your knowledge of his false ID's to pursue such...if he clings to this he is a fool as you appear to be serving him in all marital responsibility.

People who are addicted to illicit drugs, prescription drugs, alcohol, and any mind altering substance may not be bad but they are, as you say, accountable for their actions. Doing time may (or may not) be a bad thing for him (and you did not mention whether you have child(ren)). While he is doing time, it is ESSENTIAL that he be seeking treatment, as is available, for his addiction(s). This will be valuable for him whether or not he is convicted of the other offenses. Realizing that you may be committed to him in all regards, you must prepare for the worst.

Public defenders are over worked but are required to provide for an "adequate" defense. A criminal defense attorney is expensive. If you have child(ren) you have a hard decision as where you allocate your resources. Focus on the positive in your life and move forward. Many Public Defenders are highly qualified criminal lawyers. But like all State systems they are over worked. You should a least consult with a criminal lawyer (like myself) who in most cases will give you a free initial consultation.
