Can an employer press chagres against a past employee for theft, even though the employer has reported the amount that was \"stolen\" to the IRS as \"income?\"

The state or the government will decide whether to press the charges. Wrongdoing by the employer is not a defense to criminal charges against the employee. However, if the employer's credibility is in issue, then it may help.
