Legal Question in Criminal Law in Maryland

filing a false deposition domestic violence

My Estranged wife at the time (12/17/2004 had filed a false deposition for an arrest warrant for assault II based on false charges I had witnesses to refute her testimony When a trial date was set she refused to testify saying she no longer wanted to press charges The case ended up Nolle Sequi yet the case remains on the courts active docket I have been told that I have no recourse for her actions and one attorney stated that so many people file these reports if Marylands Courts persued action against these people the court system would grind to a halt My life ground to a halt after 12hrs in jail being evicted when the landlord found out the sherriffs came cuffed me and took me to jail there must be some recourse I have I have no idea how long this remains on the active docket and worry everyday that the ewx wife does not pull another stunt like this

I hope you can help me in this mess

Thank You--name removed--

Re: filing a false deposition domestic violence

First of all, you have a right to have the records of this arrest and charge expunged. My firm would be glad to help you with that, if you are interested. Second, unfortunately because you say this incident happened over 2 years ago, you probably do not have the ability this late in the game to file charges against her or file a lawsuit against her.
