Legal Question in Criminal Law in Maryland
I have a friend who was caught for underage drinking at college. The officer asked to see ID, and as she was taking it out, the officer caught a glimpse of a fake ID that she also in her wallet. He asked her if it was a fake and she gave it to him. She now face a $500 fine. Would she have been okay if she had put the wallet away and said it was not a fake? Or would the officer then have had a right to search her?

Whether a search and seizure is justified depends on whether a judge finds probable cause that the officer's action was reasonable. If a defendant moves to suppress the seized evidence, then the court has a hearing and both sides try to persuade the court. I offer a free initial consultation.
