Legal Question in Criminal Law in Maryland
My husband has two crimes that he was charged with over 13 years ago. Mal Dest of Property under 500 and Theft under 300. They have come back to haunt him. Over a year ago he was laid off and now that he has to put in job applications because they were guilty verdict he has to include them as well. Can they be expunged some way or another. He just needs to know what to do to get them removed.
1 Answer from Attorneys
Guilty findings may not be expunged. Additional information about expungement is available at mdcourts.gov. If there is a sufficient record still available that would help your husband carry the burden of proof that the guilty findings were in violation of the law, then perhaps a court might set them aside. Challenging prior convictions can be time-consuming and expensive.
