Legal Question in Criminal Law in Maryland
Hi, My Husband has been incarcerated for 2 years and he has been granted an 8-505/8-507, my question is once he got to the county jail,other inmates are telling him that no one has left for treatment and it's taking 3-6 months for them to move to the rehab. Even though it's the law that he recieves treatment within 90 days of the courts recieving his certified paperwork from DHMH. I called the Luitenant of the jail and she said it was due to funding. Can you tell me who I can call to help this process ("OUR LIFE") to proceed. I called the facility/rehab he's going to and they have beds available. PLEASE HELP!!

Unfortunately, I have heard this too. I am not aware of anything that you might do to accelerate the process. I have warned clients that pursuing 8-507 might result in additional incarceration than if they had not pursued it. Good luck.
