Possibly. The state may charge all offenses related to one incident in a single charging document. Some may not ultimately be called as a result of a negotiated plea. Also, that count may have been mistakenly charged.

Are you asking whether a new charge for theft will violate a current CDS conviction for which you are on probation? Or are you asking whether the cops arrest people for Theft because they have been convicted of prior CDS cases? Yes and yes. The cops routinely scrutinize citizens with drug convictions more than they would normal folks.
