Maryland courts take a dim view of hitting a cop. Your daughter's best path now is to contact a criminal lawyer, like myself, to begin preparing a defense. The first thing her lawyer should do is contact the State's attorney, to see if this can be worked out without giving your daughter a criminal record.

This depends upon the severity of the charges your daughter is facing, in the event she is charged with a felony for assaulting a police office...felony charges can result in jail sentences of 5 years or longer and a severe fine. However, it is highly unlikely your daugher was charged with a felony, rather a misdemeanor or a summary charge, but in any event you need to retain legal counsel to advise her ASAP.

It will depend on the jurisdiction, prosector, judge and how much the officer pushes the issue. In addition, your daughter's record will play into the equation.
