Legal Question in Criminal Law in Maryland
I would like to know what the likely outcome will be for the following charges: Any information will be much appreciated.
CJIS 3-3550 CR5 601 POS OPIOID RES on spoon
CJIS5-3550 CR5-619 POS clean needle
I am 25 years old, have an expunged felony, and also wondering if entering a rehab program will help with outcome.
1 Answer from Attorneys
The maximum penalty is likely 4y for possession of opioid and a $500 fine for possession of paraphernalia. If your prior felony were for narcotics, then that fact may change the maximums. Otherwise, the outcome is likely probation. However, each prosecutor and judge may view a particular case's facts differently. A harsh prosecutor may seek jail, a harsh judge may give it, and it would be a legal sentence.
