Can an owner of a home be removed from home if an occupant files assault charges and the occupant be allowed to stay in the house and homeowner not?

Possibly. For example, if a dependent, such as a child or a spouse, would have nowhere to go and no means of support, then the court might order the homeowner to leave, because that person has the resources to survive outside of the home.
