Legal Question in Criminal Law in Maryland
if i have a paraphernalia charge that was placed on STET docket... does it mean that i have "pending criminal charges" against me. I am applying to colleges and I'm not sure if I have to disclose this information or not

Colleges are getting smarter than they used to be. They used to ask whether you had been "convicted" of any crime. Now they are smart and know to ask the "pending criminal charges" question. Yes, if you are currently under a STET , it means that the trial for your case has been indefinitely postponed until you have completed the terms of the STET (likely to complete a drug awareness class and/or community service?). If you don't complete the STET, the case will proceed against you. If you do complete the STET, the matter will never come to trial.
In other words, since you are under a STET, you have "pending criminal charges against you" and should disclose it. A word to the wise here. If you are applying to a public university (for instance, University of Maryland), you should know that if you lie on your application, you are also lying to the government and that could bring criminal charges. If you are applying to a private school, the same rules will not apply.

There is no pending court date, but anyone may chech your information in Maryland CaseSearch to see whether you have had charges. If it has been three years since the entry of stet, you may have that case expunged from public records. If less, then you may be able to petition for early expungement.
