Legal Question in Criminal Law in Maryland

third party

My husband has a trial set with the state of maryland, and is stating that I deposited unemployment checks into our account without him knowing. He has me coming in as a third party defendent, and says that if I say that I put them in withoiut him knowing at the trial, then I will only have to pay the money back, and not be put in jail. Is this true?
