Legal Question in Criminal Law in Maryland
A passenger in a car was charged with illegal possession of an item found in the trunk. He had no knowledge of the item, he was only getting a ride.
He is accused of having an illegel object. Under what rule can a Motion to Dismiss be filed?

Since the passenger is facing jail time, he should get a criminal trial lawyer, rather than file motions himself, as he can do himself more harm than good.

A motion to dismiss challenging sufficiency of the evidence may only be made after the prosecution rests its case.
