Legal Question in Criminal Law in Maryland
Someone has previous felony charges in the district of columbia for which they were never incarcerated and completed their probation. He is currently on probation for a misdemeanour possession charge for marijuana. The police executed a search warrant on their home in Maryland where less than 10lbs of marijuana were confiscated. He pleaded guilty. What is the liklihood of him serving time or is there a possibility that he can get probation for this charge?
1 Answer from Attorneys
Some incarceration is likely on the new charge, for violating probation, or both. However, the ultimate answer depends on what the state seeks, whether there is a plea agreement, and whether the court binds. These depend on which jurisdiction in Maryland is involved and who the judge and prosecutor are. I offer a free initial consultation.
