Legal Question in Criminal Law in Maryland

Someone was pulled over for speeding and when the officer asked for their license they realized it was a fake ID. The officers searched the car and found 25 pounds of marijuana and arrested them and the passenger. When they were taken to the police station they called immigration in and found out that the individual is illegal. The person was held on $350000 bail until immigration stepped in and refused bail. The individual claims the drug is not theirs. What are the chances that the charges will be dismissed and this person not get deported? This happened in Maryland...

What you are looking for at the outset is an illegal search that could lead to the drugs getting suppressed. But to answer this simple question in a reasonably proper fashion is a lot more complicated than it may seem. You need to immediately consult with an attorney and provide all relevant documentation. To even have a chance of winning this case, this person will need an excellent attorney.

The chances of dismissal are slim, unless the police did something illegal in finding the drugs. The state is as likely to just dismiss as a defendant is to just plead guilty.
