Legal Question in Criminal Law in Maryland
Can my record get expunged or can i file for a motion to reconsider. in the state of maryland?
was charged with 7 theft accounts in md. I plead guilty to 1 account (theft under $500). Received probation and to pay back the amount i took. The other charges where put on the stet docket. All charges are on the same case file(even the ones on stet) The disposition was in 2008(when i was convicted) which has been over 4years. I have not been in trouble since then. I just graduated from college this year and having trouble getting a job in the IT Industry. When employers do background checks everything comes up even the stet charges, which makes it look bad. I have talk to many lawyers and some say it can be expunged some say it cant, some say i can do it myself. I'm Confused. If i can get this expunged can something be done so only my background shows the 1 conviction charge.

You need to call or email me with the case # so I can look it up. Depending on whether or not you received probation before judgment, you may be eligible now or may have to file a motion and go to court.
Maryland law does not permit expungement of a conviction for theft. Nor does it permit expungement of charges entered stet or nolle prosequi at the same time as a conviction for theft. More information about expungement is available at mdcourts.gov.
Motions to modify must be filed within 90 days of judgment, and they must be heard with in five years, or else the court loses jurisdiction.
