Sec Deg Assault

My wife and I are going through a nasty divorce and custody battle. She filed a couple of domestic violence protective orders which were dismissed. About a week ago she came by the house late at night and hit me. The police charged her with sec deg assault. I also filed a protective order. The police checked the probable cause block. It was a minor incident and I was wondering how serious the state's atty will take it and whether they are likely to simply dismiss it since there were no injuries other than a bruise on myself. I don't want to ruin the woman but she has got to stop harrassing me.

You can never be sure if the government will actually charge a person. Sometimes, it has a lot to do with the complaining witness (that's you) and how much that person cooperates. On the other hand, most jurisdictions are taking domestic violence a lot more serious, because of things that have happened, so they may not dismiss it. Good Luck.
