can i settle out of court for misdemeanor theft? they already have the equipment in question.

You might be able to reach a plea agreement in which you plead guilty in exchange for the state recommending a particular sentence. This would avoid a trial, but you would need to know whether it is a bargain in the sense of whether you make out better than you would if you lost a jury trial.
