Whether to have a lawyer is up to you and him. Generally, diversion is a good thing in that charges would be dropped after your son participates in counseling, mediation, and perhaps community service.
If the matter does not resolve with a dismissal of charges, then whether to have a lawyer should be based on whether your son is familiar enough with the law, rules of procedure, and rules of evidence not to be taken advantage of by the state, which will be represented by an attorney.
