A complaint may be filed by a police officer, so a charge can be brought without the school having filed anything. From your description, I would guess that he has been charged with malicious destruction of property, which is a misdemeanor in Maryland. In most instances, the main concern for the court is that the damages are paid for. Depending on your son's prior record, if any, there may be additional consequences. I would recommend consulting with an experienced criminal defense attorney to discuss the specific charge or charges.
Depending on the cost of what was damaged, the maximum penalty would be either 3y and $2,500 or 60d and $500.
Yes, but how will they prove it? Get a lawyer.
