My son violated his restraining order against his wife. what determines the penalty that he could receive.

The law provides a maximum of 90 days confinement and a $1,000.00 fine for a first offense and a year and $2,500.00 fine for a second or subsequent offense. The sentencing judge has discretion how much of that to impose and whether to suspend it in favor of probation. The severity of the offense, the defendant's prior record, and mitigation all affect the penalty.
