Legal Question in Criminal Law in Maryland
After taking a class on the subject, I am applying for a Maryland handgun permit to become an armed security guard. The Maryland State Police application asks if I've ever been arrested or charged with a crime. I was -four times in my lifetime, and had them all expunged. As such, I feel I shouldn't have to answer and should reply "no." However, the application says that I could be prosecuted for providing false information. According to a court brochure, it reads, "The state also may not require you to disclose expunged information when you apply for a state license, permit, or other registration." Can I say "no" without repercussions?

If the question were "convicted," then you might honestly answer no. However, expungement does not change the fact that you have been arrested and charged. "No" in this case would not be an honest answer.
