Legal Question in Criminal Law in Maryland

will my boyfriend have to pay bail for a common assault charge. he was charged with assault when he was a minor but it has been expunged from his record and he is on 1 year of unsupervised robation for a petty drug charge. will they give him bail if so about how much? and can he get out on his own recong in this situation. if no and no to bail what is it looking like for him. PLAESE HELP!!!!

This is a question that can't be answered without looking at the case. The judge must set a bail that is not excessive and reasonable to secure the Defendants appearance in Court.

A commissioner will make a preliminary bail determination based on the liklihood of failing to appear and the risk to public safety. Perhaps the commissioner will even release him on personal recognizance. If he cannot post bail, he will have a bail review by a judge. I offer a free initial consultation.
