Legal Question in DUI Law in Maryland

Alcohol Citation

I wasn't sure which Area of Law to

put this under, so I put it under the

closest one.

I received an alcohol citation in

Howard County, Maryland on July 14,

2009 for possession of alcohol under

the age of 21. They wrote on the

citation ''holding bottle and took one

sip.'' No breathalyzer was given and

we actually were not drinking. I turn

21 in 2 weeks.

How will this affect renewing my

license or my charges for the

citation?

Re: Alcohol Citation

Your actual age on the date of offense is not a defense, because you were not of legal age. However, it may mitigate the seriousness of the offense and punishment. The breathalyzer is irrelevant for a possession charge, but could bear on the credibility of the witness against you versus your credibility.

Unless you were charged with an offense under Maryland's Transportation Article, such as a traffic violation too, it would probably not affect your driver's license. If you failed to pay a fine, MVA might suspend your privilege.
