To answer your questions: Yes, you may still be charged with DUI, and being charged may violate a probation. Most probation orders include a requirement that you report any new charges to your probation agent. Failing to report a new violation may in itself be a violation of probation. Whether or not the State can PROVE you were behind the wheel depends on several factors. You definitely need to speak with an experienced DUI attorney. I always provide a free initial consultation. If you admitted to the police officer you were driving, you can be charged. Talk to an experienced lawyer, like myself, about your defenses.

Anyone can be accused, regardless of whether he or she actually violated the law. Conviction will violate probation, and so will failure to inform your agent of the charge. An attorney can assist you by evaluating your case, advising you of your options and the likelihood of success, and advocating for you. I offer a free initial consultation.
