Legal Question in Family Law in Maryland

1-in my divorce document it says i have sole physical custody of my children but we have joint legal custody, I might need to move out to another state 8 hrs away will i be allowed to do this? 2-i signed a seperation agreement stating that if my ex husband doesnt work he doesnt have to pay child support, well i didnt know he was going to continually not work, in 3 years he has worked maybe 6 months what can i do about that?

What does the order state about notifying him about your impending move? In most orders, there is a notice requirement when one parent wants to move out of state. Also, if you intend to move out of state, you would have to modify custody to change the joint legal custody provision.

Furthermore, you can always file a contempt petition for his failure to work You may be able to argue the unemployed provision related to involuntary unemployment, not intentional unemployment. In other words, there is a good faith assumption.

You should return to your original attorney for these new court matters.
