Bank will not take action

My stbx refinanced the marital home, and took out all the equity.

He did it with the intent of foreclosing, his 1rst pymnt wasn't due until Sept. 07 and he called me in Aug telling me he was foreclosing!

And on the deed of trust, he stated he was unmarried!

I called the mortgage co. and informed them and they told me he can do that since my name was never on the existing mortgage or title. But I was told it is a Federal offense to lie on a loan application.

And I informed them that he is able to afford the new mortgage pymnt! He used the equity he took out to pay off everything else he had plus paid cash for another home.

Why is noone willing to help me?

Even my own atty. is telling me to settle for only a few thousand when my share would have been close to 100K!!!

Marital assests and marital debts comprise the marital estate. This estate is subject to division under the law of the state where the divorce is being sought. Your attorney should be representing your interests and in doing so each and all of these details need to be discussed with your attorney.
