Legal Question in Family Law in Maryland

child health insurance-divorce decree

Because my health insurance plan is better it was so ordered that my ex husband pay me the money for our son's health insurance premium. However he has not and refuses to ''give me money''. What are my options? can this be something that could be enforced through Child Support services?

If you've got a court order requiring your ex-husband to pay your child's health insurance premium and he's not paying, your husband is in contempt. You can bring a contempt action yourself, or the MD CSEA may help. Here's a helpful URL: http://170.224.111.196/csea/index.htm

This order can be enforced as part of a child support order, or stand alone, by an earnings withholding order if your ex is employed and gets a regular paycheck. You get such an order from the court and serve it on the employer. Of course, if he is un-or self-employed, this won't work very well. You could then file a motion asking the court to order him to show cause why he shouldn't be held in contempt of court for disobeying a court order.
