does a grandmother have legal custody of a grand child if mother can not provide for child

No. The parent always has custody until a court order directs it elsewhere. The grandmother could apply to a court for a guardianship over the grandchild, and if the mother consents it would probably be awarded.

No, custody is granted via court order. It does not automatically attach to the person who is caring for the child.
