Legal Question in Family Law in Maryland

custody modification

My 7 year old son found a wallet containing $800 in it at a store. He turned it in to his father, who in turn, stole it, and was caught on tape. He has been found guilty of grand larceny and his sentencing is this summer. The court is conducting a PSI hearing. What does this entail? We have 50/50 physical and legal custody. Do I stand a chance of modifying my custody? This is his first offense. What is the likelihood that he will go to jail?

Re: custody modification

A PSI is pre-sentence investigation conducted by the probation department to advise the judge on what would be an appropriate sentence the father. Then there will be a sentencing hearing before the judge. Jail is probably unlikely for a first offense, but the conviction may be enough to change physical, if not legal, custody to you.
