Legal Question in Family Law in Maryland
My daughter's father and I were never married and don't have a child custody/visitation order in place. She has lived me since birth and in October 2012 I had let her father take her for a couple of months so that I could get back on my feet. We agreed I would see her in December for Christmas. He calls me hours before I am to leave to tell me he wasn't meeting me with her. He won't answer my calls and that if I tried to pick her up from school that he would have me arrested. Can the school deny me access to my daughter without a court order? I live in GA and he is in Maryland.

If he hasn't legitimated the child and sough custody/visitation, you have legal custody of the child. First, call the police in Maryland and inform them that the father does not have legal custody, but refuses to return the child to you. You can schedule a time to meet the police at the school to pick up your daughter. At the same time, you can also call Child Protective Services. The agency can take immediate custody of the child until you come.
I am licensed and practice in Georgia and Maryland and would be happy to discuss the matter with you further before or after you obtain custody. In any event, there is an benefit to having one attorney who practices in both states.
