Divorce mediator
I have been separated for a year and
my husband and I are amicably
getting a divorce in July. If we know
how we are splitting assets (with the
exception of IRAS and retirement- we
have no clue how that works), can
we just use a mediator and avoid
court/lawyers? Will they be able to
handle those tricky savings accounts
and real estate transfers? (He is
buying me out of the house and I will
live in an apartment)

Although you may have agreement on the basic issues, you may not realize the number of things that must be addressed in any comprehensive separation and property settlement agreement. I am a court-approved mediator and experienced in family law. I can meet with you both (you split the fees) determine if there is agreement on all key issues and draft an agreement for your review. If it is acceptable, you can both execute it (or review it with separate counsel, if desired) and then it can be incorporated into a filing for uncontested divorce based on separation. If you have an agreement on the issues and all you need to do is have Court Ordered retirement divisions, you do not need an attorney representative and probably don't need a mediator. The only reason you would need a mediator is if you have differences as to how to separate the property. You would need an attorney who specializes in drawing up "QDROs" Those are special Court Orders that are approved by the Fund Administrators and passed by the Court.
